General Terms of Use and Services for Schools
Welcome to Math Ascension, we’re delighted to see you using our game! Before using it, please read the following General Terms of Use and Services carefully.
0. In Brief
- If you are an educational institution, Math Ascension is offered to you free of charge, and we are committed to keeping Math Ascension free for such use.
- Upon receiving the approval of your access request, access will be granted for one year. It will then be automatically renewed each year without any action required on your part.
- As far as possible, we will take the necessary steps to keep Math Ascension accessible to all your students for the duration of your access.
- We ask that you ensure your students use the School Key only on your institution’s devices. In case of home access, only Student Keys should be used.
1. General Information
These General Terms of Use and Services (hereinafter also referred to as “GTUS”) are intended to define the terms of use of Math Ascension (hereinafter also referred to as the “Game”) and the services provided by Pestorosso Games Sàrl.
By acquiring or using Math Ascension, the Client (hereinafter also referred to as the "Licensee") accepts these GTUS.
Pestorosso Games Sàrl (hereinafter referred to as the "Provider") is the entity supplying subscriptions to Math Ascension.
Any person using a Math Ascension subscription is referred to as a “User.”
Only the French version of these GTUS is legally binding.
2. Description of the Service
The Provider grants the Client a non-exclusive license to use the Math Ascension game for a renewable one-year period.
When the Client acquires a Math Ascension license, the Provider agrees to allow the affiliation of the number of devices and/or creation of the number of user accounts provided for by the license. Each account is individual and grants access to Math Ascension for the duration of the license only.
Access to the game is provided in the form of one or more activation keys to the Client, enabling the creation of user accounts and/or affiliation of devices as specified in the license.
3. Obligations of Pestorosso Games Sàrl
For the entire duration of the license, Pestorosso Games Sàrl undertakes to keep the Math Ascension game operational and, to the extent possible, to promptly resolve any bugs reported, despite the care taken in the game's development.
Math Ascension has been developed to function on as many devices as possible through the use of standard web browsers (Google Chrome, Mozilla Firefox, Safari). However, Pestorosso Games Sàrl cannot be held responsible if one or more devices become incompatible for any reason.
By acquiring a license, the Client gains access to the game as-is. They may not demand corrections or additions to the content. Any request for added storyline, visual, and/or gameplay elements must be the subject of a separate agreement. The Provider is free to add these new elements to all licenses offered to other clients. Pestorosso Games Sàrl retains full ownership of all intellectual property rights to the Game, including all custom developments or specific configurations requested by the Client.
The acquisition of a license does not include technical support from the Provider. If needed, the Client may request such services, which will be billed separately.
Since the Game depends on a third-party internet provider, Pestorosso Games Sàrl cannot be held responsible for any temporary unavailability of access to the game.
However, Pestorosso Games Sàrl commits, as far as possible, to scheduling maintenance operations impacting online availability of the game outside business hours (8 a.m. - 6 p.m. CEST), and to doing everything possible, in collaboration with infrastructure partners, to ensure the highest possible accessibility to the Game during the subscription period.
The Provider cannot be held responsible for any partial or total loss of data transmitted or stored as a result of errors directly or indirectly attributable to the Client or the Users (e.g., accidental account deletion).
The Provider disclaims all responsibility for direct or indirect damages suffered by the Client or third parties resulting from the use of the Game.
4. Obligations of the Client
By subscribing to a Math Ascension license, the Client agrees to:
- Prevent unauthorized third-party access by taking appropriate precautions (secure password, etc.) and ensuring that their activation key(s) are not shared with anyone other than the Users designated by the Client and the Provider.
- Use the School Key only on devices owned by the Client. Use on Users’ personal devices is prohibited. Only Student Keys, assigned to each student, are intended for such use.
- Keep their devices and software up to date to ensure optimal operation of Math Ascension. Pestorosso Games Sàrl cannot be held responsible for issues resulting from the use of an outdated version of the Game, failure to install updates, or the use of unsuitable hardware, configuration, or internet connection.
- Report, where possible, any issue or bug that hinders the User experience.
- Not reproduce or modify the Game.
- Not create generic User accounts that could be used by multiple people and ensure that Users do not share their login information with third parties.
- Supervise the use of Math Ascension by minor Users. As with any digital product, the use of Math Ascension by minors requires adult supervision. By offering the game to minors, the Client accepts responsibility for their activities and may not hold Pestorosso Games Sàrl liable for any issues resulting from inappropriate use of the Game.
If the above conditions are not met, the Provider reserves the right to restrict or block access to the game, temporarily or permanently.
5. Renewal and Price Changes
Once the initial duration has expired, the license is automatically renewed year after year, unless terminated in writing with at least one month’s notice before the expiration date.
Pestorosso Games Sàrl aims to continue offering Math Ascension free of charge to educational institutions. No price increase is being considered.
6. References
The Provider reserves the right to cite the Client’s name as a reference, particularly on its website.
If the Client does not wish to be mentioned, they must inform the Provider in writing.
7. Legal Jurisdiction and Applicable Law
Swiss law applies to the relationship between the Provider and the Client.
Any dispute relating to a Math Ascension license and/or these GTUS shall be subject to the exclusive jurisdiction of the Geneva courts, subject to appeal to the Federal Court in Lausanne.
8. Changes to the Terms of Use
We may update these terms of use from time to time. We recommend checking this page regularly to stay informed of any changes. We will notify you of any changes by publishing the new terms on this page.
These terms take effect on 25.03.2025.
Only the French version of these terms of use is legally binding.
